ARTICLE 2 – SUBJECT

ARTICLE 4 – SHIPPING AND DELIVERY

4.1. The cargo company that the SELLER will use for delivery sends it via navlungo for shipments made abroad, and for shipments sent abroad, it sends it domestically and by PTT. The BUYER/CONSUMER’s order will be sent to the shipping company within 3 business days after the order date. After the Shipping Customer Number is reflected in the system, the product/products are delivered to the delivery address by the shipping company no later than 10 business days to the country and 5 business days to the country. This period may be extended up to a maximum of 30 days from the day the order is submitted in accordance with applicable consumer legislation in case of any problems with shipments.

4.2. Subject to the contract, the product will be delivered to the BUYER /CONSUMER or the person/persons provided with the above identification information at the address indicated above within the time specified above, depending on the distance of the BUYER/CONSUMER’s place of residence for each product, provided that it does not exceed the legal period.

4.3. The BUYER / CONSUMER is obliged to inspect the goods as soon as he receives the goods and inform the Cargo officer who delivers the goods if there is a defect and submit it to the cargo record.

4.4. The delivery of the product will be made to none other than the person/persons authorized to receive the delivery specified in the Contract. At the time of delivery, the identification of the persons authorized to take delivery is mandatory. If the product subject to the contract is to be delivered to a person/persons other than the BUYER / CONSUMER, the SELLER cannot be held responsible for the failure of the person/persons to be delivered to accept the delivery.

4.5. The shipping cost specified in the table above, which is the cost of product shipment, will be paid by the BUYER/CONSUMER. The shipping cost is the price applied for a product.

ARTICLE 5 – GENERAL PROVISIONS

5.7. If the SELLER is unable to deliver the product subject to the contract within the time limit due to force majeure or weather opposition that prevents transportation, interruption of transportation, fire, earthquake, flood, epidemic disease, the SELLER is obliged to inform the BUYER / CONSUMER of the situation. In this case, the BUYER / CONSUMER can use one of the rights to cancel the order, replace the product subject to the contract with a precedent, if any, and/or postpone the delivery time until the elimination of the blocking situation. If the BUYER/CONSUMER cancels the order, the amount paid will be refunded to him as he paid.

5.8. If the BUYER /CONSUMER makes payments by credit/debit card, the amount of the product will be refunded to the relevant bank within 14 (fourteen) days after the cancellation of the order by the BUYER /CONSUMER. The reflection of this amount in the BUYER/CONSUMER accounts after its return to the bank within a period of 14 (fourteen) days is entirely related to the bank transaction process. Despite the fact that the SELLER has paid the bank during this period, the SELLER is not responsible for extending the bank’s refund period.

ARTICLE 6 – RIGHT OF WITHDRAWAL

The SELLER undertakes that the BUYER/CONSUMER has the right to withdraw from the contract by refusing the goods or services within 14 (fourteen) days from the date of delivery or signing the contract without any civil and criminal liability and without any justification and that the SELLER will take the goods back from the date of receipt of the withdrawal notice to the SELLER or Provider. In case of exercising the right of withdrawal:

The right of withdrawal may not be exercised in the following cases:

c) Contracts for the delivery of goods that may deteriorate quickly or expire.

d) Contracts for goods that are mixed with other products after delivery and cannot be decomposed by nature.

f) Contracts for the delivery of periodicals, such as newspapers and magazines, except those provided for under the subscription agreement.

d) Contracts for services performed instantly in electronic form or for intangible goods delivered instantly to the consumer.

ARTICLE 7 – DEFAULT STATUS AND LEGAL CONSEQUENCES

ç) Provincial Consumer Arbitration Committees are responsible for disputes between 6,920 (six thousand nine hundred twenty) Turkish Liras and 10,390 (dec thousand three hundred ninety) Turkish Liras in districts affiliated to provinces that are not under metropolitan status.
